IS IT COMPULSORY TO PROVIDE DATA?

The provision of data by the data subject is mandatory in order to fulfil the data subject's requests, i.e. registration, purchase or contact requests.

Any refusal to provide data will make it impossible to provide the requested service, preventing the interested party from registering, making a purchase and/or contacting Evert s.r.l..

The provision of data collected through technical cookies is compulsory in order to proceed with the navigation of the site, while it is optional for analytical and profiling cookies.

 

TO WHOM ARE THE DATA COMMUNICATED?

The data collected and processed by the Data Controller will not be communicated to persons other than the Data Processors and persons authorised to process the data by Evert S.r.l.

 

HOW LONG IS THE DATA PROCESSED FOR?

The data collected via the www.motoabbigliamento.it website are stored and processed only for as long as the purposes for which they were collected persist, i.e:

The Data Controller will reply as soon as possible, and in any case within one month from receipt of the request or, if further time is needed to process the request, within a maximum of two months; in the latter case, the Data Controller will inform the Data Subject of the reasons for the delay.

If the data controller does not consider it necessary to process the request, it will communicate its refusal directly to the data subject within one month of receipt of the request. In this case, the data subject may lodge a complaint with the Control Authority of his/her country or appeal to the Judicial Authority of his/her country.

The exercise of the Data Subject's rights is free of charge, unless the request is manifestly unfounded or repetitive: in this case, the Data Controller may charge a fee or refuse the request.

 

The Data Subject may exercise his or her Right of Access, pursuant to Art. 15 EU Reg. 2016/679, by addressing a request to the Data Controller in order to obtain confirmation as to whether or not data relating to him or her is (or is not) being processed. By the same means, he/she may request to know what data are being processed and for what purposes; how long they are kept; whether the data have been or will be communicated to other entities, and, if so, the identity of those entities and the country where they are located, as well as the existence of adequate guarantees for the transfer; the existence of the right to request the rectification, restriction or deletion of one's own data; the existence of the right to object to the processing; the existence of the right to lodge a complaint with a Supervisory Authority; the existence of an automated decision-making process, including profiling, and the consequences of such processing. The Data Subject may exercise his or her Right to erasure, pursuant to Article 17 EU Reg. 2016/679, by making a request to the Data Controller to have the personal data collected and processed by Evert S.r.l. erased in any of the following cases: if the personal data are no longer necessary in relation to the purposes for which they were collected; if the Data Subject has withdrawn his/her consent to the processing; if the Data Subject has objected to the processing; if the personal data have been unlawfully processed by the Data Controller; if the data must be erased in order to comply with a legal obligation to which the Data Controller is subject; if the Data Subject is under 16 years of age and persons exercising parental responsibility have not given their consent.

If the Data Controller has disclosed the personal data of the Data Subject and is obliged to delete them, it will inform any further parties who are processing the data of the Data Subject of the request for deletion, to the extent that this is technically and economically feasible.

 

The Data Subject may exercise his or her Right to restriction, pursuant to Art. 18 Reg. 2016/679 EU, by addressing a request to the Data Controller so that the processing of the data is limited solely to the storage of the data, without the Data Controller being able to carry out any other operations, in one of the following cases: if the Data Subject contests the accuracy of the data, for the time necessary for the Data Controller to verify; if the processing is unlawful and the Data Subject objects to the erasure; if the Data Controller no longer needs to process the data but must retain it for judicial reasons; if the Data Subject has objected to the processing, for the time necessary for the verification of the balance between the Data Subject's rights and the Data Controller's legitimate interests.

 

The Data Subject may exercise their Right to object, pursuant to Article 21 EU Reg. 2016/679, at any time and for reasons related to their particular situation. This right may be exercised by sending a notice to the Data Controller in the event that the processing is based on the legitimate interest of the Data Controller or in the event that the data are processed for scientific research or statistical purposes.

 

The Data Subject may exercise his/her Right to the portability of personal data, pursuant to Article 20 EU Reg. 2016/679, by addressing a request to the Data Controller in order to receive in a structured, commonly used and machine-readable format the personal data concerning him/her. In the same manner, the Data Subject may request that his or her data be transmitted to another Data Controller.

However, the exercise of this right may not infringe the rights and freedoms of others.

The data will be communicated in .csv format.

 

In the event that the Data Subject considers that the processing of his or her personal data is carried out in violation of EU Regulation 2016/679, he or she has the right to lodge a complaint with the Supervisory Authority, pursuant to Art. 77 EU Reg. 2016/679, choosing between the Supervisory Authorities of the Member State where he or she resides, the Member State where he or she works or the Member State where the alleged violation occurred.

In any case, the Data Subject may also act to protect his/her rights by appealing to the Administrative and/or Judicial Authorities of his/her country.

 

The Data Subject may revoke his/her consent to the processing of his/her data at any time, in the same way he/she gave his/her consent or by sending a communication to the Data Controller. Withdrawal of consent will not affect the processing already carried out, but will result in the interruption of the processing in progress and the destruction of the data of the Data Subject.
